Duty-Free Type 86 Entry for Chinese Imports Ends

The U.S. Customs and Border Protection (CBP) has issued new import restrictions in response to President Trump’s February 1, 2025, Executive Order targeting the synthetic opioid supply chain in China. Effective February 4, 2025, most imports from China and Hong Kong will no longer qualify for duty-free entry under the de minimis exemption.


De Minimis Exemption Revoked: Chinese imports can no longer enter tax- and duty-free under 19 U.S.C. § 1321(a)(2)(C).


Stricter Entry Requirements: Importers must now file formal or informal entries and pay applicable duties, taxes, and fees.


No Exemptions for Pre-Cleared Shipments: Even if a manifest was filed or an Entry Type 86 (ET86) was created before 12:01 a.m. ET, February 4, shipments arriving after this time will not qualify for de minimis clearance.


ACE System Updates & Error Codes:

  • Air Manifest: New error messages (181, 110, 188) will reject invalid shipments.

  • Truck Manifest: If error 470 (Invalid Country of Origin) appears, clearance will be denied.

  • All Modes: If a 1M or 4E message is received, de minimis clearance is canceled.
